Terms of Service

Welcome to Kapizox. These Terms of Service ("Terms") govern your access to and use of the Kapizox mobile application and website (collectively, the "Platform"), operated by Kapizox ("we", "our", or "us"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Platform. By using Kapizox, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

2. User Accounts

To access most features of the Platform, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring your account information remains accurate and up to date

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Creator Accounts

Creators are visual professionals (photographers, videographers, drone operators, video editors, and reel creators) who list their services on the Platform. As a creator, you agree to:

• Provide accurate information about your skills, experience, and service areas
• Only upload content (photos, videos) that you own or have the right to use
• Honour confirmed bookings to the best of your ability
• Maintain professional conduct with clients at all times
• Not misrepresent your qualifications or past work

Creator profiles are subject to admin verification before becoming publicly visible. We reserve the right to reject or remove any profile that does not meet our standards.

4. Client Accounts

Clients are individuals or businesses who use the Platform to discover and hire creators. As a client, you agree to:

• Provide accurate event and booking information
• Only submit booking requests with genuine intent to hire
• Treat creators with respect and professionalism
• Submit honest and accurate reviews based on real experiences
• Not attempt to circumvent the Platform to engage creators outside of it

5. Bookings

Kapizox facilitates connections between clients and creators. All booking requests are subject to admin review and confirmation. By submitting a booking request, you acknowledge that:

• Booking requests are not guaranteed until confirmed by an admin
• Once confirmed, the booking is a commitment between the client and creator
• Kapizox acts as a facilitator and is not a party to the agreement between client and creator
• Any disputes arising from bookings are between the client and creator

We are not responsible for any losses, damages, or disputes arising from bookings made through the Platform.

6. Payments

Currently, Kapizox does not process payments directly. Pricing is displayed for transparency and agreement purposes. Payment terms are to be agreed upon between the client and creator. We are not liable for any payment disputes between users.

7. Reviews & Ratings

Clients may submit reviews for creators after a booking. Reviews must be:

• Based on genuine, first-hand experience
• Honest, fair, and not defamatory
• Free from offensive, discriminatory, or inappropriate content

Users are limited to 4 reviews per creator within any 30-day period. We reserve the right to remove reviews that violate these guidelines. You may not offer incentives to influence reviews.

8. Content & Intellectual Property

You retain ownership of content you upload to the Platform (photos, videos, etc.). By uploading content, you grant Kapizox a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform.

You must not upload content that:

• Infringes any third party's intellectual property rights
• Is defamatory, obscene, or unlawful
• Contains malware, spam, or deceptive material
• Violates any applicable laws or regulations

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Harass, abuse, or harm other users
• Create fake accounts or impersonate others
• Attempt to reverse-engineer or exploit the Platform
• Scrape or harvest data from the Platform without permission
• Engage in any activity that disrupts or interferes with the Platform
• Self-book, self-like, self-follow, or self-review your own profile

10. Account Termination

You may delete your account at any time through the app settings. Upon deletion, your profile will be removed and your personal data anonymised. We may also suspend or terminate your account at our discretion if you violate these Terms, without prior notice.

11. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not endorse any creator or guarantee the quality of their services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Kapizox shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or dissatisfaction with services provided by creators.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the Platform after changes constitutes your acceptance of the new Terms.
